Companies Can Be Sued For Asking These 9 Inappropriate Questions In An Interview?

Hiring managers use the job interview to learn as much about the candidate as possible. To do that, they ask lots of questions – including ones that may seem harmless, but are completely illegal.Recruiters with the company’s best interests in mind try to ask you for every detail about yourself that they feel would help them answer it.

However, there are a few questions that are off limits.

In case you didn’t know this, asking questions relating to a candidate’s personal life – age, race, religion, pregnancy etc. – is illegal in technical terms, says Mental Floss. The point is to defend job-seekers against discrimination based on these factors and to help make the recruitment process standardised and more importantly, objective. Take a look at the specific questions that fall in this category.

1. “Are you married?”

Attempting to dig into a candidate’s marital status or plans is utterly unethical, even if the recruiter seems to only be trying to get to know them better. Details of familial nature are by no measure an indicator of one’s professional ability and that is how they should be treated.

2. “Do you have or plan to have children?”

Whether or not one has or plans to have children may affect their personal lives, but as long it does not reflect in their work performance, it’s a detail entirely irrelevant to the recruitment process. A company could well be considered way out of line for enquiring about a candidate’s plans in this regard.

3. “How do you plan to balance your work and family responsibilities?”

This is one question in particular that finds itself strategically inserted into most women’s interviews. Juggling the roles of wife, mother and daughter doesn’t come easy. But questioning an individual’s ability to remain professional owing to these factors, simply because she’s a woman, is not only acutely sexist, but grossly unethical.

4. “How old are you?”

Apart from confirming that a candidate is above 18, this question has no place in an interview because it is in fact against all norms of propriety to discriminate against people above 40 years of age. Asking someone more mature about their age could be a possible indicator of such age-based discrimination.

5. “Do you have any disabilities or health problems?”

If the job you’ve applied to is one that is physically demanding, the interviewer reserves the right to tell you what exactly the job requires of you and then ask whether you can meet those requirements. But any health-related questions outside of this context are considered highly inappropriate.

6. “What are your religious affiliations?”

There should be no religion-related talk in an interview. It’s as simple as that. Religion is a personal choice that you don’t have to, and shouldn’t discuss in a professional setting. Discrimination based on a candidate’s religious tendencies is gravely unethical and if faced by the question, the only appropriate response would be, “I prefer not to discuss my religion, but I can assure you that it will not interfere with my doing this job.”

7. “Have you ever been arrested?”

While an employer is entitled to asking whether or not a candidate has been convicted of a crime, their arrest record is off limits. A candidate is not obligated to discuss their arrest history with a recruiter, though employers often do their own research on candidates and at times uncover incriminating details. In such cases, being upfront about a criminal history may be a good idea to establish that it is a thing of the past.

8. “What country are you from?”

As long as a candidate is authorised to assume employment where the job is located, it should be irrelevant what country they hail from or whether English is your first language. One’s nationality has no reflection in their job performance and this question is illegal for that very reason.

9. “Do you like to drink socially?”

Unlikely to come up in an interview at all, this question has specifically been categorised as illegal in an interview setting to protect those who may answer it with, “No.” It protects the identities of recovering alcoholics, thus defending them against unethical treatment. Additionally, while one may ask whether a candidate is currently using any illegal drugs, it is against the law to ask them when they last used them.

Importance of Attitude

There was a man who made living selling balloons at a fair. He had all colors of balloons Including red, yellow, green. Whenever business was slow, he would release a helium filled balloons into the air and when the children saw it go up, they all wanted to buy one. They would come up to him, buy a balloon and his sales would go up again. He continues this process all day. One day, he felt something tugging his jacket. He turned around and saw a little boy who asked,” If you release a black balloon, would that also fly?” Moved by the boy’s concern, the man replied with empathy.” Son, it is not the Color of the balloon, it is what inside that makes it go up.”

The same thing applies to our lives. It is what is inside that counts. The thing inside of us that makes is go up is our attitude my dear Friends 👍

रिश्तों की अहमियत

पिताजी जोऱ से चिल्लाते हैं ।
प्रिंस दौड़कर आता है, और पूछता है...
क्या बात है पिताजी?
पिताजी- तुझे पता नहीं है, आज तेरी बहन रश्मि आ रही है? 
वह इस बार हम सभी के साथ अपना जन्मदिन मनायेगी..
अब जल्दी से जा और अपनी बहन को लेके आ,
हाँ और सुन...तू अपनी नई गाड़ी लेकर जा जो तूने कल खरीदी है...
उसे अच्छा लगेगा,
प्रिंस - लेकिन मेरी गाड़ी तो मेरा दोस्त ले गया है सुबह ही...
और आपकी गाड़ी भी ड्राइवर ये कहके ले गया कि गाड़ी की ब्रेक चेक करवानी है।
पिताजी - ठीक है तो तू स्टेशन तो जा किसी की गाड़ी लेकर
या किराया करके?
उसे बहुत खुशी मिलेगी ।
प्रिंस - अरे वह बच्ची है क्या जो आ नहीं सकेगी?
आ जायेगी आप चिंता क्यों करते हो कोई टैक्सी या आटो लेकर-----
पिताजी - तूझे शर्म नहीं आती ऐसा बोलते हुए?  घर मे गाड़ियाँ होते हुए भी घर की बेटी किसी टैक्सी या आटो से आयेगी?
प्रिंस - ठीक है आप जाओ मुझे बहुत काम है मैं जा नहीं सकता ।
पिताजी - तूझे अपनी बहन की थोड़ी भी फिकर नहीं? शादी हो गई तो क्या बहन पराया हो गई ?
क्या उसे हम सबका प्यार पाने का हक नहीं?
तेरा जितना अधिकार है इस घर में,
उतना ही तेरी बहन का भी है। कोई भी बेटी या बहन मायके छोड़ने के बाद पराई नहीं होती।
प्रिंस - मगर मेरे लिए वह पराई हो चुकी है और इस घर पर सिर्फ मेरा अधिकार है।
तडाक ...!
अचानक पिताजी का हाथ उठ जाता है प्रिंस पर,
और तभी माँ आ जाती है ।
मम्मी - आप कुछ शरम तो किजीऐ ऐसे जवान बेटे पर हाँथ बिलकुल नहीं उठाते।
पिताजी - तुमने सुना नहीं इसने क्या कहा, ?
अपनी बहन को पराया कहता है ये वही बहन है जो इससे एक पल भी जुदा नहीं होती थी--
हर पल इसका ख्याल रखती थी। पाकेट मनी से भी बचाकर इसके लिए कुछ न कुछ खरीद देती थी। बिदाई के वक्त भी हमसे ज्यादा अपने भाई से गले लगकर रोई थी।
और ये आज उसी बहन को पराया कहता है।
प्रिंस -(मुस्कुराकर)  बुआ का भी तो आज ही जन्मदिन है पापा...वह कई बार इस घर मे आई है मगर हर बार अॉटो से आई है..आपने कभी भी अपनी गाड़ी लेकर उन्हें लेने नहीं गये...
माना वह आज वह तंगी मे है मगर कल वह भी बहुत अमीर थी । आपको मुझको इस घर को उन्होंने दिल खोलकर सहायता और सहयोग किया है। बुआ भी इसी घर से बिदा हुई थी फिर रश्मि दी और बुआ मे फर्क कैसा। रश्मि मेरी बहन है तो बुआ भी तो आपकी बहन है।
पापा... आप मेरे मार्गदर्शक हो आप मेरे हीरो हो मगर बस इसी बात से मैं हरपल अकेले में रोता हूँ। की तभी बाहर गाड़ी रूकने की आवाज आती है....
तब तक पापा भी प्रिंस की बातों से पश्चाताप की
आग मे जलकर रोने लगे और इधर प्रिंस भी~~
कि रश्मि दौड़कर पापा मम्मी से गले मिलती है..
लेकिन उनकी हालत देखकर पूछती है कि क्या हुआ पापा?
पापा - तेरा भाई आज मेरा भी पापा बन गया है ।
रश्मि - ए पागल...!!
नई गाड़ी न?
बहुत ही अच्छी है मैंने ड्राइवर को पीछे बिठाकर खुद चलाके आई हूँ और कलर भी मेरी पसंद का है।
प्रिंस - happy birthday to you दी...वह गाड़ी आपकी है और हमारे तरफ से आपको birthday gift..!!
बहन सुनते ही खुशी से उछल पड़ती है कि तभी बुआ भी अंदर आती है ।
बुआ - क्या भैया आप भी न, ???
न फोन न कोई खबर,
अचानक भेज दी गाड़ी आपने, भागकर आई हूँ खुशी से~~~
ऐसा लगा कि पापा आज भी जिंदा हैं ..
इधर पिताजी अपनी पलकों मे आँसू लिये प्रिंस की ओर देखते हैं ~~~
और प्रिंस पापा को चुप रहने का इशारा करता है।
इधर बुआ कहती जाती है कि मैं कितनी भाग्यशाली हूँ~~
कि मुझे बाप जैसा भैया मिला,
ईश्वर करे मुझे हर जन्म मे आप ही भैया मिले...
पापा
मम्मी को पता चल गया था कि..
ये सब प्रिंस की करतूत है,
मगर आज फिर एक बार रिश्तों को मजबूती से जुड़ते देखकर वह अंदर से खुशी से टूटकर रोने लगे। उन्हें अब पूरा यकीन था कि...मेरे जाने के बाद भी मेरा प्रिंस रिश्तों को सदा हिफाजत से रखेगा~
बेटी और बहन
ये दो बेहद अनमोल शब्द हैं
जिनकी उम्र बहुत कम होती है । क्योंकि शादी के बाद बेटी और बहन किसी की पत्नी तो किसी की भाभी और किसी की बहू बनकर रह जाती है।
शायद लड़कियाँ इसी लिए मायके आती होंगी कि...
उन्हें फिर से बेटी और बहन शब्द सुनने को बहुत मन करता होगा~~

शिक्षा - रिश्तें एक दुसरे के प्रति विश्वास को बढाते हैं और विश्वास से आत्म विश्वास बढ़ता हैं और जब किसी को आत्मविश्वास या खुद पर विश्वास हो जाए तो वह कुछ भी कर सकता हैं. जीवन के किसी भी लक्ष्य को प्राप्त कर सकता हैं. रिश्तें मनुष्य के जीवन में बहुत ही महत्वपूर्ण भूमिका निभाते हैं. रिश्तें हमें त्याग करना सिखाते हैं, प्रेम करना सीखते हैं और एक दुसरे के दुखो में भी शामिल होने के लिए प्रेरित करते हैं.
